Terms of Service
The contract for using Inchess, including account duties, user content rules, moderation rights, disclaimers, and indemnity.
Agreement
These Terms of Service are a binding agreement between you and the operator of the Inchess service. By creating an account, signing in, uploading content, publishing a course, sharing a course, commenting, or otherwise using Inchess, you confirm that you have read and accepted these Terms, the Privacy Policy, the User Content and Copyright Policy, and the Community Guidelines.
If you use Inchess on behalf of an organization, you represent that you are authorized to bind that organization. If you do not agree to these documents, you must not use the service.
Acceptance Records
Inchess may record which legal document versions you accepted, when you accepted them, and limited request context connected to the acceptance flow. These records help determine which rules applied to an account and help resolve legal, security, or abuse disputes.
When material legal terms change, Inchess may require you to accept the updated version before you can continue using protected features.
Eligibility And Minors
You must be legally able to use online services and enter into these Terms under the laws that apply to you. If you are not old enough to use the service independently under the laws that apply to you, you may use Inchess only with approval and supervision from a parent or legal guardian, or from an authorized school, club, or organization where permitted by law.
Adults who authorize a minor's use of Inchess are responsible for that minor's activity, content, and compliance with these Terms.
Accounts
You are responsible for accurate account information, secure credentials, and all activity that occurs through your account. You must not share credentials, impersonate another person, create misleading identities, or use another person's account without permission.
You must notify Inchess through the available reporting or support channels if you believe your account has been compromised or used without authorization.
User Content Responsibility
You are solely responsible for courses, chess lines, annotations, comments, images, video links, text, PGN, metadata, names, profile data, and any other material you submit, upload, publish, import, share, or make available through Inchess.
You must only submit content that you own, that is in the public domain, that is lawfully licensed to you, or that you otherwise have the right to use in the selected access mode. You must not submit content that infringes copyright, trademark, privacy, publicity, database, contract, confidentiality, or other rights of any person or organization.
You must not upload, publish, or share personal data or private information about another person without lawful authority, including information about children or students, private contact details, addresses, private messages, identifying images, or confidential information.
Content License
You keep ownership of your content. Subject to your privacy, access, and sharing settings, you grant Inchess a worldwide, non-exclusive, royalty-free license to host, store, copy, reproduce, adapt, display, transmit, analyze, back up, moderate, and otherwise use your content as needed to operate, protect, troubleshoot, and improve the service.
This license allows Inchess contractors and service providers to process content only as needed to operate the service for Inchess.
For private content, the license is limited to operating the service for your account, enforcing these Terms, maintaining security, and preserving records needed for legal or dispute reasons. For content you share with named users or through a link, the license includes making that content available to the selected recipients. For public content, the license includes displaying the content publicly and making reasonable previews, indexes, or excerpts available inside Inchess.
Inchess may use public content and public course metadata in limited service promotion, discovery, and educational examples. Inchess will not use private or non-public course content in external marketing without your permission, except as necessary for legal, safety, security, or service-operation reasons.
Publishing And Sharing
When you publish a course publicly, create link access, or grant direct access, you confirm again that you have the rights needed to share every included asset and that the course does not create legal risk for Inchess or other users.
Inchess may remove, hide, restrict, demote, disable sharing for, or delete content at any time if we believe it violates these Terms, creates risk, receives a credible legal complaint, or may expose Inchess or users to harm.
Prohibited Conduct
You must not use Inchess unlawfully, attack or probe the service without authorization, interfere with other users, upload malware, scrape in abusive ways, bypass access controls, manipulate sharing permissions, harass others, publish hateful or exploitative content, or misrepresent yourself or your rights.
You must not use the service to distribute copyrighted books, course material, puzzle sets, images, videos, annotations, databases, or other protected works unless you have permission or another lawful basis.
Moderation And Enforcement
Inchess may investigate suspected violations, remove or restrict content, suspend or terminate accounts, limit features, revoke access, preserve evidence, notify affected parties, and cooperate with law enforcement or rights holders when appropriate.
We may act without advance notice when we believe the issue is urgent, legally sensitive, security-related, abusive, or likely to harm users, Inchess, or third parties. Enforcement decisions may consider the report details, available account history, content visibility, repeat behavior, and the risk created by the content or conduct.
Deletion And Export
You are responsible for keeping copies of content that matters to you. Inchess may provide product features or support paths for accessing, editing, deleting, or exporting some account or course data, but the service does not guarantee that every item can be exported in every format.
Deleting an account or content may not immediately remove every copy. Inchess may retain information when needed for legal compliance, security, backup recovery, abuse prevention, rights disputes, financial records if any, or enforcement of these Terms.
Inchess Materials And Feedback
The Inchess name, interface, software, design system, product features, documentation, templates, and service materials belong to Inchess or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you rights to use Inchess branding except as allowed inside the service.
If you send feedback, ideas, or suggestions, you allow Inchess to use them without restriction or compensation. Do not send feedback that you cannot lawfully share.
Service Availability
The service is provided on an as-is and as-available basis. Inchess does not guarantee uninterrupted availability, error-free operation, accurate analysis, complete course data, training results, compatibility, or preservation of any content.
You are responsible for keeping your own backups of important content and for deciding whether any chess analysis, training output, or user material is suitable for your use.
Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Inchess, its owners, operators, contributors, contractors, service providers, and representatives from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your account, your content, your publication or sharing choices, your breach of these Terms, or your violation of any law or third-party right.
Limitation Of Liability
To the maximum extent permitted by law, Inchess will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, reputational harm, or claims arising from user content, third-party content, moderation decisions, access restrictions, service outages, or reliance on the service.
Nothing in these Terms limits liability that cannot legally be limited.
Changes
We may update these Terms and related policies. When a material version changes, Inchess may require users to accept the new version before continuing to use protected features.
Any dispute will be handled under the law and forum that validly apply to the Inchess service operator and the user relationship, including any mandatory consumer protections that cannot be waived.
